1. Introductory provisions

1.1. These terms and conditions (the “Terms”) govern the rights and obligations of the organiser, Radek Rosa (the “Organiser”), and people registering for his specialist courses, workshops and other in-person educational events (the “Participant”).

1.2. The Terms apply exclusively to educational events that the Organiser organises and sells in his own name. They do not apply to personal training, online coaching or events organised by others at which Radek Rosa acts solely as an instructor.

1.3. The Terms form part of the contract for attendance at an educational event.

1.4. A Participant may be a consumer or a person acting in the course of their business. Consumer protection provisions apply in accordance with the relevant legislation.

1.5. The specific date, venue, programme, price and other conditions are stated on the relevant event's sales page or in an individual written offer.

2. Registration and formation of the contract

2.1. Registration normally takes place through the Organiser's website and the Stripe payment gateway. Exceptionally, attendance may be arranged individually by email.

2.2. Before completing an order, the Participant has the opportunity to review the course's main features, date, price, payment method and these Terms.

2.3. By submitting a binding order, the Participant expresses an interest in attending and acknowledges the obligation to pay the agreed price.

2.4. The contract is formed when the Organiser confirms the order, including through his automated ordering system where applicable.

2.5. The Organiser will send the Participant an order confirmation and contractual information, including these Terms, electronically in a format that can be retained.

2.6. If the order cannot be accepted, particularly because the event is full, the Organiser will inform the Participant and refund any payment received in full.

2.7. The Participant is responsible for the accuracy of the details provided in the order.

3. Price and payment terms

3.1. The price is stated on the relevant sales page or in an individual offer. The Organiser is not VAT registered.

3.2. The standard payment method is online payment through the Stripe payment gateway.

3.3. By individual agreement, the Organiser may allow another payment method, particularly bank transfer.

3.4. In exceptional cases, the Organiser may offer payment in instalments. There is no automatic entitlement to instalments.

3.5. The amount and due dates of instalments must be agreed in writing in advance, for example by email.

3.6. Unless otherwise agreed, the full price must be paid before the course starts.

3.7. The Participant will receive proof of payment in accordance with the law.

3.8. The price does not include travel, accommodation or other personal expenses unless expressly stated otherwise.

4. Cancellation by the Participant

4.1. The Participant may cancel their attendance by emailing info@radekrosastrong.cz.

4.2. Cancellation is determined by when the Organiser receives the notice and the number of calendar days remaining before the course starts.

When attendance is cancelledRefund amount
14 or more calendar days before the start100% of the price paid
7–13 calendar days before the start50% of the price paid
Fewer than 7 calendar days before the start0% of the price paid

4.3. Failure to attend without prior notice does not entitle the Participant to a refund, unless otherwise required by law.

4.4. These cancellation terms govern the contractual settlement of voluntary cancellation and do not restrict consumers' statutory rights, in particular any right to withdraw from the contract or rights relating to defective performance.

4.5. Any amount due for refund will normally be returned using the original payment method, no later than 14 days after confirmation of a valid cancellation, unless the law provides otherwise.

4.6. For individually agreed instalments, cancellation is settled on the basis of the total agreed price and amounts already paid, in accordance with the contract and the law.

4.7. In justified cases, the Organiser may offer an individual arrangement beyond these cancellation terms, such as transferring attendance to another date.

5. Transferring attendance to another person

5.1. The Participant may transfer their registration to another person free of charge.

5.2. The change should preferably be notified at least 24 hours before the course starts by emailing info@radekrosastrong.cz.

5.3. The notice must state the original participant's name and the replacement participant's name and contact email.

5.4. The Organiser will confirm the transfer and provide the replacement participant with the necessary organisational information.

5.5. The Organiser may allow a transfer notified later if it is organisationally feasible.

5.6. The replacement participant must comply with these Terms.

6. Withdrawal from a distance contract

6.1. If the Participant enters into the contract as a consumer online or by another means of distance communication, the relevant provisions of the Czech Civil Code apply.

6.2. Consumers generally have the right to withdraw from a service contract within 14 days of its formation without giving a reason, unless a statutory exception applies.

6.3. The Civil Code provides exceptions, for example for certain leisure services supplied on a specific date. Whether an exception applies depends on the actual nature of the particular service; it cannot automatically be applied to every educational event.

6.4. Where the consumer has a right to withdraw, they may exercise it by sending an unambiguous notice to info@radekrosastrong.cz or to the Organiser's registered office. They may use the model form in the annex.

6.5. Refunds and any settlement for the part of the service already provided are governed by the relevant legislation.

6.6. Statutory withdrawal cannot be made conditional on payment of a contractual cancellation fee.

7. Cancellation by the Organiser

7.1. The Organiser may cancel a course, particularly for serious organisational, health or technical reasons.

7.2. If the course is cancelled, the Participant will be offered the choice of moving their registration to another suitable date or receiving a refund of 100% of the price paid.

7.3. Accepting an alternative date is voluntary.

7.4. The Organiser will normally return the payment within 14 days of receiving the Participant's choice.

7.5. The Organiser does not reimburse travel, accommodation or other indirect expenses unless required to do so by law.

7.6. The Organiser will inform Participants of the cancellation without undue delay.

8. Changes to the venue, date or programme

8.1. The Organiser may make reasonable organisational changes that do not alter the essential features of the agreed course.

8.2. The Organiser may change the specific sports facility within the originally announced city if the new venue offers comparable conditions, is reasonably accessible and the change has no substantial negative effect on the Participant.

8.3. A non-material change of venue within the same city does not automatically entitle the Participant to a refund.

8.4. The Organiser will give reasonable advance notice of a change.

8.5. If the date, venue or scope of the course changes materially, the Organiser will seek agreement with the Participant. Any termination of the contract and refund are governed by law.

8.6. Minor changes to the schedule or order of educational sessions are possible provided they do not substantially reduce the quality and scope of the course.

9. Course delivery and practical activities

9.1. Courses may include theoretical teaching, practical exercises, demonstrations, professional discussion and other educational activities.

9.2. Participation in practical exercises is voluntary. The Participant may choose not to take part in particular exercises.

9.3. Participants must follow the Organiser's safety and organisational instructions and the venue's rules.

9.4. Participants should take their health, capabilities and limitations into account. If they are unsure whether an activity is suitable, they should not take part without further assessment.

9.5. The Organiser may restrict participation in a specific activity for safety reasons.

9.6. Voluntary participation in practical activities does not constitute a waiver of statutory rights. The Organiser's liability for any harm is governed by law.

9.7. The Organiser may intervene reasonably in the event of serious breaches of safety rules or disruption of the educational event.

10. Learning materials and copyright

10.1. Selected courses may include electronic handouts, presentations, videos of methods and other specialist materials, as specified in the offer.

10.2. Materials will be provided or made available on the course date or during the course, in accordance with the Organiser's instructions.

10.3. A Participant who cancels before the course starts has no separate entitlement to receive the materials unless otherwise agreed individually or required by law.

10.4. Copyrighted learning materials are protected by the applicable legislation.

10.5. The Participant may use the materials for their own education and professional work within the scope of the permission granted.

10.6. Without the Organiser's prior consent, participants may not, in particular, make complete presentations and handouts publicly available, distribute copies of paid materials or commercially distribute continuous recordings of specialist teaching where doing so infringes copyright.

10.7. These restrictions do not apply to the specialist knowledge itself, generally known methods or uses permitted by law.

11. Photography, video recordings and their use

11.1. The Organiser gives notice that photographs and visual or audio recordings may be made during educational events to document the workshop, present the Organiser's work and promote further educational events.

11.2. Selected photographs and videos may be published on the Organiser's website and official social media profiles, particularly Instagram and Facebook, or used in online promotional campaigns, including paid advertising for future courses and workshops.

11.3. Participants will be informed in advance about planned photography and filming, for example in instructions sent before the event and through notices at the venue.

11.4. Participants who do not wish to be photographed, filmed or shown in publicly published materials may inform the Organiser in advance by emailing info@radekrosastrong.cz, or inform the organiser or photographer in person at the venue. Advance notice helps ensure suitable positioning out of shot or another organisational arrangement. Participants may also express their wishes later.

11.5. The Organiser will respect privacy requests and take reasonable measures to ensure that people who do not wish to be recorded or published are not recognisably published without an appropriate legal basis. Measures may include choosing a different shot, editing it or not publishing it.

11.6. For targeted marketing use of participants' identifiable likenesses, particularly close-up photographs and videos or use in paid advertising, the Organiser will obtain the necessary permission from the people concerned and, where consent is the appropriate legal basis, separate consent to personal data processing in advance.

11.7. Consent to marketing use of an identifiable likeness is not a condition of attending a course. Withholding consent or expressing an objection does not affect the ability to attend the educational event.

11.8. Where use of a person's likeness is based on permission or consent, that person may request its withdrawal by emailing info@radekrosastrong.cz. The Organiser will then act in accordance with the relevant legislation and address removal or further use of the materials on channels under his control. Content already shared further by third parties may not always be removable retrospectively.

11.9. Attendance at a workshop or failure to object in advance does not automatically constitute consent to unrestricted marketing use of a Participant's identifiable likeness.

11.10. Participants may take their own photographs and short videos during a course for personal or educational use, provided this does not disrupt teaching and respects other people's rights.

11.11. Without the Organiser's prior consent, longer continuous recordings containing substantial parts of copyrighted specialist teaching or presentations may not be distributed publicly or commercially.

11.12. Participants may publish short clips documenting the atmosphere of the workshop provided they respect the rights of the people shown, copyright and other legal requirements.

11.13. Detailed information about any processing of personal data in connection with photographs and videos is set out in the separate Privacy Policy.

12. Complaints and rights relating to defective performance

12.1. The Participant may make a complaint if a course was not provided in the agreed scope or quality.

12.2. Complaints may be submitted to info@radekrosastrong.cz or in writing to the Organiser's registered office.

12.3. A complaint should state the Participant's name, course name and date, a description of the issue and the requested resolution.

12.4. The Organiser will acknowledge receipt of a complaint and deal with it in accordance with the relevant legislation.

12.5. A consumer complaint will be resolved and the consumer informed no later than 30 days after it is submitted, unless the parties validly agree a longer period and the law provides otherwise.

12.6. Where a complaint is justified, the Participant has the rights appropriate to the nature of the defect and the relevant legislation.

13. Personal data protection

13.1. The Organiser processes Participants' personal data primarily for registration, organisation of educational events, communication, payments and compliance with legal obligations.

13.2. Data may also be processed to the extent necessary by the payment service provider Stripe and other providers involved.

13.3. Where the Organiser creates and uses photographs or video recordings showing identifiable people, and this constitutes personal data processing, he acts in accordance with the GDPR and other applicable legislation.

13.4. Detailed information about processing purposes, legal bases, recipients, retention periods and data subjects' rights is provided in the Privacy Policy at www.radekrosastrong.cz/en/gdpr/.

13.5. Acceptance of these Terms does not in itself constitute consent to marketing communications or separate consent to marketing use of an identifiable likeness.

14. Alternative dispute resolution for consumers

14.1. If a dispute arises, the parties will first seek an amicable resolution.

14.2. A consumer may contact the competent alternative dispute resolution body:

Czech Trade Inspection Authority
Central Inspectorate – ADR Department
Gorazdova 1969/24
120 00 Praha 2
Email: adr@coi.gov.cz
Website: https://coi.gov.cz/informace-o-adr/

14.3. This does not affect the right to bring proceedings before the competent court.

15. Final provisions

15.1. The Terms are governed by the law of the Czech Republic. Consumers' statutory rights remain unaffected.

15.2. If a provision is invalid or ineffective, this does not in itself affect the validity of the remaining provisions.

15.3. The Organiser may update the Terms. Contracts already concluded remain governed by the version effective when the contract was formed, unless the parties validly agree otherwise.

15.4. The Terms are available at www.radekrosastrong.cz/en/obchodni-podminky/.

15.5. These Terms take effect on 1 January 2026.
